1. Reservation and Cancellation Policy:

The reservation will be made according to the availability of El Balcón De Potes S.L.

The formalization of the reservation is subject to the payment of the total amount of the contracted service by bank transfer/application in case the reservation is made in person or the delivery of the cash/TPV in case the reservation is made at the establishment.

The additional breakfast service may be contracted together with the reservation, and prior to the date of arrival, in the same way, it may be contracted the day before use, however, in this case, an additional supplement to the price initially shown in the reservation may be charged.

This reservation allows modifications up to 14 days before the arrival date. Also, free cancellation is allowed up to 14 days before the date of arrival. In this sense, 100% of the amount paid will be refunded.

In case of cancellation between 13 and 7 days prior to the arrival date, 50% of the amount paid will be refunded.

Finally, in case of cancellation less than 7 days in advance, no refund will be made.

Reservations made through any other portal other than elbalcondepotes.com's own booking engine may have cancellation policies completely different from those mentioned above and no exceptions will be made.

2. Rules of Use and Behavior:

The established schedule for Check-in is from 15:00 hours, if applicable, and always subject to availability of El Balcón De Potes S.L., in case the arrival is made before the established time and the room is not ready for use, you can leave the luggage and enjoy the facilities. On the other hand, the maximum check-out time is 11:00 a.m., with the possibility of extending the stay subject to availability and subject to a supplement, if applicable.

The breakfast service offered by El Balcón De Potes S.L., will be carried out between 8:30 and 10:30 am. It is important to communicate before the start of the service in case the guest suffers from any food allergy or intolerance.

The use of the swimming pool area is limited to the established schedule, which will be communicated by the establishment depending on the time of the year, weather conditions or any other relevant fact that El Balcón De Potes S.L. may consider.

Likewise, only registered Guests may use this facility. Children under 10 years of age are not allowed without the supervision of a responsible adult, and it is strictly mandatory to take a shower before using the pool.

In this regard it should be noted that there is no lifeguard present, in compliance with the provisions of Article 21 of Decree 72/2008 of July 24, which approves the Health Regulations for Swimming Pools for Collective Use of the Autonomous Community of Cantabria. The use of the pool is under the user's own responsibility, although it is strictly forbidden to run, jump from the edges or play rough games that may endanger the physical integrity of the user and other users.

For hygienic reasons, access is prohibited to persons with skin infections, open wounds or contagious diseases. The consumption of alcohol and the entry of glass containers into the pool area are also prohibited.

The use of the gym area is limited to the established schedule, which will be communicated by the establishment, conditioned, if necessary, to any relevant fact that El Balcón De Potes S.L. considers relevant.

Only registered Guests may use this facility, being not allowed access to children under 10 years old without the supervision of a responsible adult, and being the use of sportswear and appropriate footwear.

In this regard, it is forbidden to use the equipment improperly. The use of the gym is under the responsibility of the user, El Balcón De Potes S.L. is not responsible for injuries resulting from improper use of the equipment.

For hygienic reasons, the equipment should be cleaned after each use with available disinfectants.

El Balcón De Potes S.L. reserves the right to admit pets. In any case, this circumstance must be communicated sufficiently in advance in order to assess by the establishment the feasibility of the acceptance of the reservation depending on the availability of common facilities.

In any case, the Guest agrees to respect the internal rules of El Balcón De Potes S.L., which include, but are not limited to:

- Proper use of facilities.

- Prohibition of illicit or annoying activities for other users.

- Respect the established schedules for the use of common areas.

3. Data Protection:

The person responsible for the processing of personal data provided is El Balcón De Potes S.L., the data provided to it will be incorporated and will be processed in automated files in accordance with the Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights, the European Regulation 2016/79 (General Data Protection Regulation) and other current regulations applicable to the matter, in order to provide our hosting services, as well as to keep you informed on issues relating to the activity of the company and its services, where appropriate.

By accepting these conditions, you give your express and explicit consent to the processing of this data and that they may be communicated or transferred in accordance with legal obligation. 4. Responsibility:

El Balcón De Potes S.L. will not be responsible for the loss, theft or damage of personal belongings of the guest, unless negligence on his part is proven. Similarly, the Guest agrees to respond to any damage caused in the facilities during the stay.

5. Applicable Law and Jurisdiction:

El Balcón De Potes S.L., is governed by the Spanish legislation in force, and any discrepancy shall be submitted to the jurisdiction of the courts and tribunals of San Vicente de la Barquera.
